14. DISPUTE RESOLUTION & ARBITRATION

To provide an efficient method for resolving disputes, you agree that any controversy or claim arising out of or relating to these Terms or your use of the Site shall be settled by binding arbitration in accordance with the rules of the American Arbitration Association (AAA).

  • Arbitration will take place in West Virginia, or a state of our choosing, before a single arbitrator.
  • The arbitrator’s decision shall be final and binding.
  • Each party shall bear its own costs and attorneys’ fees, unless otherwise required by law.
  • You waive any right to participate in a class action or class arbitration.

Notwithstanding this clause, AMD retains the right to seek injunctive or equitable relief in court to protect its intellectual property or confidential information.


15. GOVERNING LAW

  • These Terms and any related transactions are governed by the laws of the State of West Virginia, without regard to its conflict-of-law principles.
  • Any non-arbitrable disputes shall be litigated in the state or federal courts of West Virginia or a state of our choosing.


16. FORCE MAJEURE

AMD shall not be liable for delays or failure to perform caused by circumstances beyond its reasonable control, including acts of God, natural disasters, war, terrorism, strikes, labor disputes, transportation interruptions, or government actions. Performance will resume once conditions permit, without penalty.


17. EXPORT COMPLIANCE CLAUSE

  • You agree to comply with all applicable U.S. export control laws and regulations, including the Export Administration Regulations (EAR) and trade sanctions maintained by the U.S. Department of Treasury.
  • You may not export, re-export, or transfer any AMD products or technology to prohibited destinations or persons.
  • AMD reserves the right to refuse or cancel any order that violates export compliance requirements.


18. LIMITATION ON CLAIMS PERIOD

Any claim or cause of action arising out of your use of the Site, purchase of products, or these Terms must be filed within one (1) year after the cause of action arises. Claims filed after this period are permanently barred, regardless of any contrary statute or law.


19. SEVERABILITY

If any provision of these Terms is held to be invalid or unenforceable, the remaining provisions shall continue in full force and effect.

  • We reserve the right to cancel any order using an unapproved discount code.


22. USER SUBMISSIONS & FEEDBACK

American Muscle Docks & Fabrication products must be installed, assembled, and used responsibly.

You acknowledge and agree that:

  • AMD is not responsible for injury, death, or property damage resulting from improper installation, assembly, modification, misuse, or neglect.
  • AMD is not liable for work performed by third-party installers, contractors, or customers.
  • Once a product leaves AMD’s possession, the customer assumes full responsibility for installation, maintenance, inspection, and safe use.
  • AMD does not guarantee the suitability of its products for every site condition, application, or environment.

Under no circumstances shall AMD be liable for any bodily injury, death, or property damage caused by the use, installation, or handling of its products, whether by the purchaser or a third party.

Customers are responsible for following all local building codes, safety standards, and manufacturer recommendations. Failure to do so may void any warranty or support.


23. ENTIRE AGREEMENT

These Terms, together with our Privacy Policy and Shipping & Returns Policy, constitute the entire agreement between you and AMD regarding the use of this Site and supersede all prior agreements, communications, or understandings (whether oral or written). No modification of these Terms shall be binding unless made in writing and posted on this website by AMD.
